NEW YORK, June 27 Oscar de la Renta Inc on Friday sued Elizabeth Arden Inc (RDEN.O) over a fragrance the cosmetics and perfume maker is selling at Wal-Mart Stores Inc (WMT.N).
The suit, filed in U.S. District Court in Manhattan, accuses Elizabeth Arden of selling a perfume made for distribution only as a free gift with other Oscar de la Renta products in Wal-Mart stores without proper authorization.
"Sale of such a product is inconsistent with the image and reputation of Oscar de la Renta and its licensed fragrance products," the fashion label said in the lawsuit.
The suit accuses Elizabeth Arden of trademark infringement and unfair competition. Oscar de la Renta is seeking a permanent injunction preventing Elizabeth Arden from selling the perfume, attorneys fees and any other remedy the court deems appropriate.
