Judge rejects Adelphia creditors' claims vs banks

NEW YORK, June 18 (Reuters) - A U.S. judge on Wednesday dismissed claims by Adelphia Communications Corp (ADPAO.PK: Quote, Profile, Research) creditors seeking to recover $4 billion from hundreds of investment funds and banks, including Bank of America Corp (BAC.N: Quote, Profile, Research), Citigroup Inc (C.N: Quote, Profile, Research) and Deutsche Bank AG (DBKGn.DE: Quote, Profile, Research).

Adelphia, which filed for bankruptcy protection in 2002, was one of the biggest corporate fraud prosecutions in recent years, along with Enron and Worldcom.

Founder John Rigas and his son Timothy, the company's former finance chief, were convicted of looting the company to pay for personal land deals and vacation homes.

The Adelphia Recovery Trust, which represents the company's creditors, had first filed a complaint in bankruptcy court in 2003 seeking to recover various amounts of money in loan obligations, payments and liens that Adelphia made prior to its bankruptcy filing.

It claimed that the loan proceeds were used by the Rigas family and not the company, and that the banks and investment funds had received more money than they should have due to fraudulent transfers.

In an order on Wednesday, U.S. District Judge Lawrence McKenna in Manhattan, found that the Adelphia Recovery Trust lacked standing to bring most of its claims in court.

In rejecting the claims, McKenna said the company's reorganization plan had paid the creditors what they were due.

"It is clear from the joint plan's provisions that all of the creditors of the obligor debtors have been paid in full," McKenna wrote in the order.

The judge did not rule on certain tort claims brought by the trust, leaving them standing.

John and Timothy Rigas are now serving prison sentences of 15 and 20 years, respectively. They asked a judge in May to reduce their sentences after an appeals court threw out one of their more than 20 convictions. (Reporting by Emily Chasan; Editing by Gary Hill)
